1. General Information

The technical information, recommendations, and application guidance provided by AddVation ApS ("AddVation") in relation to its products are based on the technical information and evaluations available at the time.

Marine and industrial operating environments vary significantly and are often influenced by factors beyond AddVation's control. Accordingly, general technical information is provided for guidance purposes only.

This Disclaimer supplements AddVation's General Terms and Conditions of Sale ("GTCS") when provided and incorporated into the agreement. Section 9 of the GTCS governs exclusions and limitations of liability under both documents. Individually agreed written terms take priority.

2. No Guarantee of Specific Performance

AddVation does not guarantee that the use of its products will achieve any specific operational, mechanical, sealing, lubrication, or performance-related result in any particular vessel, system, component, or industrial installation.

Product performance may vary depending on factors including, but not limited to:

  • equipment condition
  • system design
  • seal condition and wear level
  • lubricant type and condition
  • operating temperature and pressure
  • contamination levels
  • maintenance practices
  • compatibility with other products, lubricants, or additives
  • method of application
  • overall operating environment

3. User Responsibility

The purchaser and end user are responsible for determining whether an AddVation product is suitable for the intended application and operating conditions.

This includes, but is not limited to, evaluating compatibility with:

  • vessel systems
  • industrial systems
  • mechanical components
  • seals, elastomers, and materials
  • existing lubricants or service fluids
  • maintenance procedures and operational requirements

The final decision to introduce the product must be made by the purchaser's or end user's authorised and competent technical personnel. Appropriate testing, verification and technical assessment must be completed where relevant before full-scale operational use.

The purchaser must ensure that personnel applying the product receive the applicable instructions and treatment plan.

4. Technical Advice and Recommendations

Any technical advice, recommendations, or application guidance provided by AddVation, whether in writing, verbally, through product literature, or by representatives, distributors, or partners, is given in good faith on the basis of information available at the time.

Unless expressly agreed in writing, such advice is provided as guidance only and shall not constitute a warranty, performance guarantee, or acceptance of responsibility for the purchaser's or end user's specific application.

The purchaser and end user remain responsible for evaluating suitability in the relevant system and conditions. Applicable product instructions, the Safety Data Sheet and an agreed treatment plan must be followed. General guidance does not override these instructions. Any liability for technical advice is governed by Section 6 below and Section 9 of the GTCS.

5. Gradual Introduction and Monitoring

For critical marine and industrial systems, products must be introduced in accordance with the applicable product instructions and any agreed treatment plan. Gradual or staged introduction applies where specified in those instructions or that plan.

This applies in particular to systems such as:

  • stern tube lubrication systems
  • thrusters
  • gearboxes
  • hydraulic systems
  • other critical circulating oil or sealed systems

Operational monitoring must be maintained throughout introduction and thereafter in accordance with the applicable instructions, treatment plan and good technical practice.

The purchaser and end user must follow relevant operating limits and stop criteria and take prompt protective action if abnormal conditions arise. Conflicting instructions must be clarified before treatment.

6. Limitation of Liability

To the fullest extent permitted by applicable law, AddVation excludes liability for direct, indirect, incidental, special, punitive and consequential loss, damage or expense arising out of or in connection with the sale, delivery, storage, handling, application or use of its products, or related technical advice or services.

This includes, without limitation:

  • operational downtime
  • vessel immobilisation
  • charter loss, off-hire or demurrage
  • loss of profit or revenue
  • equipment malfunction or damage
  • maintenance costs
  • production loss
  • indirect or consequential losses

This exclusion does not remove the express product or intellectual property remedies in Sections 7 and 8 of the GTCS.

If AddVation is nevertheless held liable, its total aggregate liability shall not exceed the net invoiced value of the specific goods giving rise to the claim, excluding VAT, freight and other separately charged delivery costs.

The exclusions and fallback limit have the scope and mandatory exceptions set out in Section 9 of the GTCS. The same combined aggregate limit applies under both documents; this Disclaimer does not create an additional or separate limit.

Nothing in these exclusions or limits restricts liability that cannot lawfully be excluded or limited. This includes mandatory product liability and any applicable mandatory restrictions concerning personal injury, fraud, wilful misconduct or gross negligence.

This Disclaimer does not waive independent rights of third parties who have not agreed to it.

7. Regulatory and Technical Compliance

The purchaser and end user are responsible for ensuring that their intended use and operation of AddVation products complies with all applicable:

  • maritime regulations
  • environmental legislation
  • classification society requirements
  • vessel manufacturer guidelines
  • equipment supplier recommendations
  • local regulatory or technical approval requirements

Subject to Section 6 above and Section 9 of the GTCS, AddVation shall not be responsible for non-compliance resulting from the purchaser's or end user's selection, handling, or use of the product.

This allocation does not transfer AddVation's mandatory supplier or manufacturer obligations, or imply any approval not expressly documented.

8. Product Changes and Updates

AddVation may update product specifications, technical information, recommendations and related documentation. Updates do not retrospectively amend agreed specifications or existing contracts.

Before use, the purchaser and end user must review the documentation applicable to the supplied product and batch and any notified safety updates. Conflicting instructions must be clarified before treatment. Urgent safety stops must be observed immediately.
